DUI in Colorado Springs: What to Expect After an Arrest

A DUI arrest in Colorado Springs triggers two separate cases against you at once: a criminal case in El Paso County court and an administrative license case at the Colorado DMV. The deadlines on both are short, and the first one arrives within a week.

The 7-day DMV deadline

If you took a breath test or refused testing, the officer usually takes your license and issues a temporary permit. You generally have 7 days from the arrest to request a DMV hearing to challenge the revocation — miss it and the revocation becomes automatic. Blood test cases work differently: you receive notice by mail after results come back and have a short window from that notice.

Express Consent and refusals

By driving in Colorado you have already consented to chemical testing under the Express Consent law. Refusing a test leads to a longer license revocation — typically one year for a first refusal — and the refusal can be used against you in court. Refusal also triggers ignition interlock requirements if you want to drive sooner.

DUI vs. DWAI in Colorado

Colorado has two alcohol-related driving charges. DUI applies at a blood alcohol concentration of 0.08% or higher; DWAI (driving while ability impaired) can be charged at 0.05% or higher, or based on observed impairment from alcohol or drugs, including marijuana. Both are criminal charges that go on your record.

First-offense penalties

A first DUI conviction in Colorado can bring jail time of five days to one year (often suspended with probation), fines and court costs, up to 96 hours of community service, alcohol education or treatment, and a license revocation of up to nine months. DWAI penalties are somewhat lower but still include possible jail, fines, and points on your license. Penalties rise sharply for high BAC, prior offenses, or accidents with injuries.

The El Paso County court process

Colorado Springs DUI cases are heard in El Paso County Court. Expect a first appearance, one or more pretrial conferences where plea offers are discussed, and either a plea or a trial.
